  • A voluntary arbitration agreement under section 42 (Form V).
  • Stamp duty on the affidavit filed with the conciliation reply, under the State Stamp Act, and its attestation.
  • The State's rules and forms where the State Government is the appropriate Government, and any State law on recognition of unions.
  • The wage-structure computation behind a settlement: use the Wage-base determination working paper in the Structuring pay under the 50% rule pack.
  • Advice on whether a particular strike or lock-out is illegal, and on any disciplinary action or wage deduction arising from it.

Four parts: the memorandum of settlement (content of Form I), the authority of the workers' signatories, the joint forwarding letter, and the individual acceptance

When a bipartite agreement is a "settlement". A written agreement reached otherwise than in conciliation is a settlement under section 2(zi) only if it is signed in the prescribed manner and a copy is sent to the officer authorised by the appropriate Government and to the conciliation officer. Under rule 4 of the Industrial Relations (Central) Rules 2026 it is recorded in Form I (or another format the parties agree), signed by the persons in rule 4(2), and a copy is sent jointly by the parties, electronically or by speed post, to the Deputy Chief Labour Commissioner (Central) concerned and to the conciliation officer (rule 4(5)). The rule fixes no time; send it within a week of signing. In the State sphere, send it to the officer named in the State rules.

Whom it binds (section 57). A settlement reached by agreement outside conciliation binds only the parties to the agreement. A settlement reached in conciliation binds all workers of the establishment, present and future. If the employer needs the terms to bind workers who are not members of the signatory union, either sign the same terms before the conciliation officer, or take individual acceptances in Part D.
