MEMORANDUM OF FAMILY ARRANGEMENT
Drafting note, to be deleted before engrossing: every operative statement in this memorandum is in the past tense. It records what the family agreed at a meeting held earlier and what has been done since in performance of that agreement. It must not contain the words “hereby transfers”, “hereby allots”, “hereby relinquishes” or any equivalent, because those words would make this document itself an instrument of partition, compulsorily registrable and chargeable with ad valorem duty.
THIS MEMORANDUM is drawn up at [Place where the Memorandum is drawn up] on this [Day of the Memorandum] day of [Month of the Memorandum], [Year of the Memorandum], by the persons named below, all being members of the family of the late [name of the common ancestor].
