SERVICE OF PROCESS AND IMMUNITY
1. Notices generally. Notices under this Agreement are given in accordance with clause [Clause number of notices] (Notices). See M.12 for the form of that clause. This clause deals separately with the service of process in legal or arbitral proceedings, which clause [Clause number of notices] does not govern.
2. Agent for service — the foreign party. The [Supplier], not having a place of business in India, irrevocably appoints [Name of the agent], of [full address in India], e-mail [e-mail], as its agent to receive on its behalf service of any claim form, application, notice of arbitration, award, order or other document in any proceeding in India arising out of or in connection with this Agreement. Service on that agent is deemed to be good service on it whether or not the document is forwarded to or received by it. It shall notify the other Party in writing of any change in the agent’s address, and if for any reason the agent ceases to act, or ceases to have an address in India, it shall immediately and in any event within 15 days appoint a replacement agent with an address in India and notify the other Party of the appointment, failing which the other Party may appoint an agent on its behalf at its cost and service on that agent is good service. Nothing in this clause affects the right to serve process in any other manner permitted by law.
