MEMORANDUM RECORDING DEPOSIT OF TITLE DEEDS
(Recorded by [Name of the lender], [Branch])
Drafting instruction, to be deleted before use: this memorandum is prepared and signed by the officer of the lender on a date after the date of the deposit. It records a past event. It must contain no word of grant, charge, transfer, mortgage or agreement to mortgage, and no covenant of any kind, or it becomes an instrument creating the security, compulsorily registrable under section 17(1)(c) of the Registration Act 1908 and inadmissible if unregistered. Check whether the State has amended section 17 to require registration of an agreement relating to a deposit of title deeds, and whether Article 6 of the State stamp schedule charges this memorandum.
