14. LIMITATION OF LIABILITY
Posture 1 — customer-friendly
14.1 Nothing in this Agreement limits or excludes the liability of either Party for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or abandonment of this Agreement, for any liability which cannot lawfully be limited or excluded, or, in the case of the Customer, for the Charges.
14.2 The liability of the Supplier is unlimited in respect of: (a) breach of clause [Clause number of confidentiality] (Confidentiality); (b) breach of clause [Clause number of data protection] (Data protection), and any penalty imposed on the Customer in consequence; (c) the indemnity in clause [13.1(a)] (Intellectual property infringement); (d) breach of clause [9.4] (Anti-bribery) or clause [21.12] (Sanctions); and (e) the indemnity in clause [13.1(d)] (Employment and labour).
