This agreement sits beside the catalogue's "Distribution agreement" or "Dealership agreement" and replaces their short discount clause with a complete scheme. Settle rebates using the catalogue's "Credit note under section 34" or "Commercial (financial) credit note, no tax adjustment"; verify claims with the "Distributor claim verification certificate"; and compute each period on the companion "Rebate claim, computation and credit note working".
Law as at 30.10.2026. Section 153 of the Finance Act 2026 substitutes section 15(3)(b) of the CGST Act 2017 from 01.11.2026 (notification dated 26.10.2026 under section 1(2)(b) of that Act, which also brings in section 154 amending section 34(1)): a post-supply discount then reduces value if the supplier issues a credit note and the recipient reverses the attributable input tax credit under section 34, without the earlier conditions of a pre-supply agreement and invoice linkage. Clause 9 is drafted to meet both the earlier and the substituted tests, because the treatment of credit notes after 01.11.2026 for supplies made before that date has not been clarified.
