The Occupational Safety, Health and Working Conditions Code 2020 (the “OSH Code”) repealed the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act 1979 and came into force on 21 November 2025; the OSH (Central) Rules 2026 (G.S.R. 345(E) of 08.05.2026, in force from that date) bind central-sphere establishments, and a State-sphere establishment follows its State's rules, using the Central Rules as the template where the State has notified none. The provisions on inter-State migrant workers sit in Part II of Chapter XI, sections 59 (application), 60 (facilities and duties), 61 (journey allowance), 62 (public distribution system and other benefits), 63 (toll free helpline), 64 (study) and 65 (past liabilities), with the portal and database in section 21(2). In the Central Rules, rule 13 deals with statistics of inter-State migrant workers and rules 102 to 104 with the journey allowance, the helpline and studies. A State-sphere establishment should check the corresponding State rules before filing anything. For the contractor's agreement and the monthly certificate, use the Contract Labour Formats (FV10-H7); this format adds what is specific to workers who cross a State line.
1. Who is an inter-State migrant worker
The OSH Code defines an inter-State migrant worker (section 2(1)(zf)) by movement and wages, not by who recruited the worker. The old Act reached only workers recruited through a contractor; the Code also reaches a worker who came on his own and found the job. Test each worker on the three elements below and record the answer in the register in Part 4.
